Michael T. Burke


Experience

Michael Burke has been a resident of Fort Lauderdale for over thirty-five years. Mr. Burke is AV rated by Martindale-Hubbell and has substantial trial and appellate experience in the state and federal courts.

For the past twenty-five years, Mr. Burke has engaged in a civil trial and appellate practice with primary emphasis on the representation of private companies as well as local governmental entities and their police agencies. Mr. Burke has extensive experience in defending local governmental entities as well as their officials and employees in civil actions including land use, regulatory takings, first amendment claims, false arrests, malicious prosecution, premises liability, automobile negligence, fraud, employment discrimination, federal civil rights litigation and general tort liability. Mr. Burke is also the author of several articles on local government liability, including Defining The Contours of Municipal Liability Under 42 USC §1983: Monell - City of Canton v. Harris, 18 Stetson Law Review, 511 (1989), and has lectured and on the subject at the request of the Florida Bar, Florida League of Cities, Broward County Bar Association and the Florida Municipal Attorneys Association. Mr. Burke also has many reported cases including Faragher v. City of Boca Raton, 111 F.3d 1530 (11th Cir. 1997); D.P. vs. School Board of Broward County, 483 F.3d 725 (11th Cir. 2007), Coral Springs Street Systems vs. City of Sunrise, 371 F.3d 1320 (11th Cir. 2004), Key West Harbour v. Key West, 987 F. 2d 723 (11th Cir 1993); and Jones v. Heyman, 888 F.2d 1328 (11th Cir. 1989), Florida Power & Light vs. City of Dania, 761 So.2d 1090 (Fla. 2001 and WCI Communities vs. City of Coral Springs, 885 So.2d 912 (Fla. 4th DCA 2004).
